What Makes a Great Trial Attorney? | Alex Settle
What makes an effective criminal trial attorney?
Is it experience, preparation, courtroom confidence, or the ability to recognize weaknesses in a case before trial?
On this episode of the Mighty MERP Podcast, New Jersey criminal defense attorney Melissa Rosenblum welcomes back Alex Settle, Esq., a former prosecutor and current attorney with the New Jersey Office of the Public Defender.
Alex is back for a conversation about what it takes to become an effective trial lawyer.
Drawing on their experience in New Jersey criminal courts, Melissa and Alex discuss the importance of trial preparation, understanding the rules of evidence, developing courtroom credibility, and knowing when to challenge the prosecution's case.
For attorneys beginning their careers, Alex recommends gaining experience in a prosecutor's office or public defender's office, where regular courtroom appearances, structured training, and mentorship provide opportunities to develop practical litigation skills.
Melissa shares three principles she emphasizes with younger attorneys:
Know your case better than anyone else in the courtroom. Understand the discovery, police reports, body-camera footage, and potential weaknesses in the evidence.
Know the law. Develop a working knowledge of New Jersey's Title 2C criminal statutes, the elements of criminal offenses, and the rules governing admissible evidence.
Be authentic. Effective courtroom advocacy requires credibility with judges and juries, not imitation of another attorney's personality or trial style.
Their discussion also explores how experienced attorneys evaluate the actual strength of criminal charges, distinguish allegations from admissible evidence, use motion practice strategically, and negotiate resolutions based on what prosecutors can realistically prove.
An important theme throughout the conversation is that effective trial advocacy begins long before a case reaches a jury.
This conversation continues a series of discussions between Melissa Rosenblum and Alex Settle examining criminal defense, courtroom advocacy, and the changing practice of law.
